4. Why we use personal information and our lawful bases
Enquiries, quotations and valuations
We use your contact and vehicle information to respond to enquiries, provide valuations, prepare quotations and discuss requested services. Our lawful bases are taking steps at your request before entering into a contract and, where appropriate, our legitimate interests in responding to genuine business enquiries.
Vehicle consignment, agency sales and purchases
We use information to market vehicles, communicate between Seller and Buyer, arrange viewings or inspections, record disclosures, prepare sale documents, receive or verify payments, release vehicles, remit proceeds and keep a proper transaction record. Our lawful bases are contract, steps taken before a contract, legal obligations where applicable, and our legitimate interests in operating a secure and properly documented disclosed-agency sales process.
Storage, detailing, PPF, transport and other services
We use information to book, provide, manage and charge for services, communicate about the Vehicle, arrange third-party work where authorised and keep service records. Our lawful bases are contract, steps taken before a contract, legal obligations where applicable, and legitimate interests in managing our services and protecting vehicles in our care.
Identity, fraud, payment, title and security checks
We may use and verify information to protect customers and the business against fraud, payment diversion, theft, unauthorised release, title problems, unlawful transactions and security risks. Our lawful bases are legitimate interests and, where a specific legal duty applies, legal obligation.
Accounting, tax, insurance and legal matters
We use transaction and service records for bookkeeping, tax, insurance, dispute handling, complaints, legal claims and regulatory or law-enforcement requests. Our lawful bases are legal obligation and our legitimate interests in protecting and enforcing our legal rights.
Website operation, security and analytics
We use necessary technical information to operate and secure the website. Where Google Analytics or another non-essential analytics technology is enabled, we use it only in accordance with the cookie choices presented to you. Necessary website/security processing is based on legitimate interests; non-essential cookies or similar technologies are used only where the required consent has been obtained.
Marketing
We do not treat use of the website or an ordinary enquiry as consent to marketing. We may send electronic marketing where you have consented or where the law permits the limited existing-customer 'soft opt-in' for our own similar products or services. You can opt out at any time. Where consent is required, consent is our lawful basis; where the soft opt-in applies, our data-protection basis is normally legitimate interests.
5. Castle Combe referral enquiries
If you use the Castle Combe client enquiry route on our website, the information identified on that form may be shared with Supercar Group Ltd and Castle Combe Circuit for the purpose of processing the enquiry and allowing Castle Combe Circuit to verify that the referral originated through that partnership. We do not use that referral arrangement as permission to share your information for unrelated marketing.
6. Who we share information with
Where reasonably necessary, we may share personal information with:
- the relevant vehicle Seller, Buyer or their authorised representative where needed for a vehicle sale;
- payment, banking and direct-debit providers used to receive, verify or make payments;
- vehicle-history, finance/title, identity, fraud and other verification providers;
- insurers, transporters, storage providers, detailers, repairers, marque specialists and other suppliers involved in an authorised service;
- our website, hosting, email, CRM, accounting, document, communications, security and IT providers;
- Google in connection with reCAPTCHA used on website forms and, where enabled with appropriate consent, Google Analytics;
- professional advisers such as accountants, solicitors and insurers;
- Castle Combe Circuit for the limited referral purpose described above; and
- law-enforcement bodies, regulators, courts or other authorities where disclosure is required or lawfully justified.
We do not sell personal information to advertisers. If a supplier processes information for us, we expect it to use the information only for the authorised purpose and to protect it appropriately.
7. Cookies, reCAPTCHA and analytics
Our website uses cookies and similar technologies. Some are necessary for security, basic website operation, form functionality or to remember your choices. Non-essential analytics or advertising technologies require the appropriate consent before they are used.
Website forms are protected by Google reCAPTCHA to help prevent spam and abuse. Google may process technical information such as device, browser and IP-related information for that security purpose under Google's own privacy terms.
Where Google Analytics is enabled, it is used to understand how visitors use the website and improve the site and our services. Analytics cookies or similar technologies should not be activated until the required consent has been given through the site's cookie controls.
You can change or withdraw non-essential cookie choices through the site's cookie controls and your browser settings. Blocking necessary technologies may affect some website functions.
8. International transfers
Some of our technology or service providers may process information outside the UK. Where a restricted international transfer occurs, we use a lawful transfer mechanism appropriate to the circumstances, such as UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to approved contractual clauses, or another safeguard or exception permitted by UK data-protection law.
9. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, insurance, fraud-prevention and dispute requirements.
- Core contracts, invoices and accounting/transaction records are generally retained for the period required for company and tax records, commonly six years from the end of the relevant company financial year, and longer where a legal or regulatory reason requires it.
- Routine enquiries that do not progress are periodically reviewed and deleted or anonymised when they are no longer reasonably needed.
- Identity or verification material is kept only for as long as reasonably necessary for the check, transaction, fraud prevention, insurance or any related legal issue.
- Marketing contact details are retained until you opt out, consent is withdrawn where consent applies, or the information is no longer needed. We may keep a minimal suppression record so that we do not contact you again.
- Cookie and analytics information is retained according to the relevant cookie/tool settings and our configured retention periods.
10. How we protect information
We use reasonable technical and organisational measures appropriate to the nature of the information and the risks involved. These may include access controls, account security, verification procedures, secure cloud services, staff controls and supplier agreements. No internet or electronic system can be guaranteed completely secure, so we do not make an absolute promise that a security incident can never occur.
11. Your data-protection rights
Depending on the circumstances, you may have the right to:
- ask for access to your personal information;
- ask us to correct inaccurate or incomplete information;
- ask for deletion of information in circumstances where the right to erasure applies;
- ask us to restrict processing in certain circumstances;
- object to processing based on legitimate interests;
- object at any time to use of your personal information for direct marketing;
- receive certain information you provided to us in a portable format where the right to data portability applies; and
- withdraw consent at any time where we rely on consent.
These rights are not absolute and may depend on the lawful basis, the purpose of processing and legal requirements. We may need to verify your identity before acting on a request.
We do not normally make decisions about customers that have legal or similarly significant effects solely by automated means.
12. Complaints
Please contact us first if you have a concern about how we use your information. You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data-protection regulator. Information about making a complaint is available at www.ico.org.uk.
13. Children
Our website and services are not directed at children and we do not knowingly seek to collect children's personal information through the website. If you believe a child has provided personal information to us inappropriately, please contact us.
14. CCTV and ANPR
Our premises are covered by CCTV and ANPR systems operated and controlled by the site landlord for security and crime-prevention purposes. Supercar Group Ltd does not operate or routinely monitor those systems. Any personal information recorded by those systems is controlled by the landlord and is subject to the landlord's own data-protection arrangements.
15. Changes to this Privacy Policy
We may update this policy when our services, suppliers or legal requirements change. We will publish the current version on our website and update the date shown at the top. A new website privacy policy does not retrospectively change a signed contract.
Website Terms & Conditions
These terms govern use of www.supercargroup.co.uk and general dealings initiated through the website.
1. About Supercar Group Ltd
Supercar Group Ltd is a company registered in England and Wales under company number 15414240. Registered office: 4 Storey Mews, Malmesbury, Wiltshire, SN16 0FH. Email: info@supercargroup.co.uk. Telephone: 07554 529366.
These Website Terms & Conditions apply to use of the website and to enquiries, quotations and bookings made through it. A specific signed agreement, booking confirmation, quotation or other written terms may apply to a particular service or transaction. If there is an inconsistency, the specific transaction document takes priority.
2. Website Use
The website is provided for information about our services and vehicles and to allow visitors to contact us. You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with its operation or use it for unlawful purposes.
We may change, suspend or withdraw website content or functionality from time to time. We take reasonable care over website content but do not guarantee that the website will always be available or error-free.
3. Vehicle Sales - Disclosed Agency
Unless we expressly state otherwise in writing, Supercar Group Ltd acts as disclosed sales agent for the legal owner of a vehicle and does not purchase or take legal or beneficial title to consigned vehicles. The vehicle sale contract is between the identified Seller and the Buyer. The Seller's and Buyer's actual legal status and the circumstances of the sale determine which legal rights apply.
A vehicle-specific Private Treaty Vehicle Sale Agreement and any clearly incorporated advert/specification, written corrections and Special Terms govern the sale. Nothing on this website changes that agency structure or removes any right or liability that cannot lawfully be excluded.
4. Vehicle Listings & Information
Vehicle descriptions, mileage/odometer information, history, ownership, accident or repair history, modifications, faults, provenance and other particulars may include information supplied by the Seller and supporting documentation made available to us. We take reasonable care to communicate material information accurately and will correct or disclose a material inaccuracy that comes to our attention before completion.
Prospective Buyers should review the full vehicle advertisement/specification, any written corrections and the sale agreement, and are encouraged to inspect the vehicle and/or arrange an independent pre-purchase inspection where appropriate.
Availability, advertised status and prices may change before a binding sale is formed. Any mandatory amount payable as part of a particular transaction will be disclosed before the customer is bound.
5. Reservations, Deposits & Payments
Any reservation payment, purchase deposit or part payment is governed by the applicable Vehicle Reservation / Purchase Deposit Receipt and/or Private Treaty Vehicle Sale Agreement. A reservation payment is not automatically the same as a binding purchase deposit.
Where Supercar Group Ltd receives vehicle purchase funds as a Seller's authorised agent, it receives them as agent and not as principal. Vehicles will not be released merely on the basis of a transfer screenshot, pending transaction or unverified payment.
6. Warranties
Supercar Group Ltd does not provide a contractual warranty or guarantee in relation to a consigned vehicle unless we expressly agree otherwise in a separate written document. If we help arrange a warranty from an independent provider, that warranty is supplied under the provider's own terms and is not a warranty from Supercar Group Ltd.
Nothing in these terms excludes or restricts statutory rights or other liability that cannot lawfully be excluded.
7. Other Services
Storage, detailing, paint correction, PPF, transport/logistics, recommissioning, repair coordination and project-management services are provided on the basis of the relevant quotation, booking confirmation and any service-specific written terms. Scope, price, timing and any customer responsibilities should be confirmed in writing before work begins.
Where we arrange work by an independent specialist or supplier, we will make the nature of that arrangement clear. Separate third-party terms or warranties may apply to work or products supplied by them.
8. Quotations, Prices & Additional Work
Quotations are based on the information reasonably available when given and remain subject to any expiry date or condition stated in the quotation. We will not add a mandatory charge after a customer is bound unless the charge was properly disclosed or the customer subsequently requests and agrees additional work or services.
Optional delivery, transport, preparation, repair or other additional services are charged only where separately agreed or otherwise lawfully payable.
9. Consumer Cancellation Rights
Consumers may have statutory cancellation rights for certain contracts concluded at a distance or away from business premises. Whether such a right applies depends on the type of contract, the parties' legal status and how the contract was concluded. Where required, we or the relevant Seller will provide the applicable pre-contract cancellation information before the consumer is bound.
10. Liability
Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
Subject to the preceding sentence and to applicable consumer law, Supercar Group Ltd is responsible for loss or damage caused by its own breach of contract or negligence to the extent required by law. We are not responsible for losses caused solely by independent third parties or events outside our reasonable control where the law permits that exclusion.
11. Intellectual Property
Unless otherwise stated, the website content created by or for Supercar Group Ltd, including text, branding, photographs, video and graphics, is owned by or licensed to Supercar Group Ltd. It may not be copied, republished or used commercially without permission, except where the law permits.
12. External Links
The website may contain links to third-party websites or services. Those sites are operated independently and their own terms and privacy notices apply. A link does not by itself mean that Supercar Group Ltd controls or endorses all content on the third-party site.
13. Privacy & Cookies
Personal information is handled in accordance with the Privacy Policy above and applicable UK data-protection law. Cookies and similar technologies are used in accordance with the information and choices presented through our cookie controls and Privacy Policy.
14. Changes to These Terms
We may update these Website Terms & Conditions from time to time. The version published when a visitor uses the website will apply to that website use. Changes to these website terms do not retrospectively change a signed transaction agreement.
15. Governing Law & Contact
These Website Terms & Conditions are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
Questions about these terms can be sent to info@supercargroup.co.uk or to Supercar Group Ltd at 4 Storey Mews, Malmesbury, Wiltshire, SN16 0FH.
